If the Congress can convince the court that this declaration is not what they intended, that would weaken POTUS' position. No Congress is bound by the actions of a previous one. They could repeal the act.

They could, but it would not apply to presidential actions taken before the law was passed; “No ex-post facto law shall obtain.” Of course, in this day and age they would just pretend it did!
