If the Congress can convince the court that this declaration is not what they intended, that would weaken POTUS' position.

No Congress is bound by the actions of a previous one. They could repeal the act.

They could, but it would not apply to presidential actions taken before the law was passed; “No ex-post facto law shall obtain.” Of course, in this day and age they would just pretend it did!

and that would put it right where we are today..President can veto and congress tries to override.
