Cletus - what do you think about GWO’s article? Since I am legally ignorant, and military courts are even more particular, I’d appreciate your thoughts on this. And maybe how it relates to Kavanaugh’s answer to Graham’s question/s.
Supreme Court rules it has jurisdiction over military court of appeals

The US Supreme Court [official website] ruled [opinion, PDF] Friday in Ortiz v. United States [SCOTUSblog materials] that it has jurisdiction to review decisions made by the Court of Appeals of the Armed Forces. It also held that simultaneously serving on both the Court of Military Commissions Review (CMCR) and the Court of Criminal Appeals (CCA) is lawful.
Dalmazzi v. United States [docket], Cox v. United States [docket] and Ortiz v. United States [docket] were three cases consolidated. Each of the petitioners were members of the Air Force who were convicted [JURIST report] of different crimes in a military court. They appealed their convictions on the grounds that only members of the military can preside over a military court, and the judges in the petitioners cases were civilians because of their CMCR position.
[T]he Constitution grants Congress an unqualified power: to legislate for the District in all Cases whatsoever. Art. I, §8, cl. 17 When Congress invoked that authority to create a set of local courts, this Court upheld the legislationeven though the judges on those courts lacked Article III protections, wrote Justice Elena Kagan for the majority.
Regarding whether one person may serve on the two different military courts within the CMCR, the court said there is no reason serving on both would result in an undue influence on his colleagues nor a conflict of interest.
The CMCR does not review the CCAs decisions (or vice versa); indeed, the two courts do not have any overlapping jurisdiction. They are parts of separate judicial systems, adjudicating different kinds of charges against different kinds of defendants.

The following was started during the recent Q drop pause. Being mindful that there is a Q flurry going on, it nevertheless seems appropriate to offer a Qanteen Qanticle for the Season. I do hope you enjoy it!

TEXOKIES QHRISTMAS MELTDOWN
*texokie, as often happens, woke to the loud bonging of the Qanteen Qlock. There is a large Qanteen dawgs head and front quarters across her legs, and some of the Qanteen Qatz are nestled against her back. One enterprising Qat is attacking her hair which apparently had transformed into The Enemy. There is a very hard jagged sharp something poking her in the ribs. Upon investigation she learns that one of the Qanteen Dawgs has deposited the large gnawing bone there before draping himself artfully, as dawgs do, over her lower extremities. Someone had thoughtfully covered the whole pack with a big feather quilt. Except for the Qlock, all is quiet in the Qanteen. She watches the Qhristmas tree lights twinkle on the big magnificent Qanteen tree while she wakes.*
*She excavates herself and pats and scratches all her little furry friends, who yawn and turn over to continue their naps. Texokie shrugs her shoulders and covers them back up after she climbs out from under the Steinweigh except for the one awake little Qanteen Qitty, who had been attacking her hair with such vigor. THAT Qitty jumps to the top of the Steinweigh and meows. Then settles into a purring furrball doing paw-tucket on the sonata manuscript someone has been recently practicing over the past few days.*
*Texokie stands up and stretches. She thinks of all she needs to do this day . She is hopelessly behind on the Q Thread, she has the research from a few digs that she REALLY wants to write up and post ..and as often happens, there has been a flurry . Not only outside in the lovely cold December winter of the Qanteen, but also from Q! ...And of course, there are other side projects she wants to do. She hasnt done any more of her Whittling lately and REALLY wants to complete a bunch more of the walking sticks she started so she can give them out for Qhristmas. YIKES!! QHRISTMAS!!! ONLY TWO WEEKS!!!*
*Darlin wants to take her for a drive in the mountains with the 4-wheel drive pickup so they can get their personal Christmas tree and some more decoration boughs for the Qanteen. (The Qlock mantle should be appropriately decorated!) They like to watch the birds, and play in the snow too ..and of course, there are things to do in the Qitchen and around the Qanteen in prep for Qhristmas! Thank goodness some of the hearty FReeQs went out after Thanksgiving and got the gorgeous Qhristmas Tree which has been set up near the Steinweigh. They even decorated it to a fare-thee-well*
