Miranda rights must be read only when one is being placed under arrest, or is under arrest and being questioned. Police and law enforcement are always allowed to ask questions when investigating a possible crime. I would have to double check the case law to see if someone who is a target of an investigation must be mirandized. (I don’t practice criminal law so my knowledge dates back to school and the bar exam, and maybe some reading since then.)
So, generally, no, you don’t have to read someone like Flynn his Miranda rights to speak with him, as the FBI agents knew. However, if the agents went in there with the intent to trap Flynn in a lie and then to use that to get him fired and/or prosecuted, as seems to be the case, then there may be some grounds to require that he have been read his Miranda rights.
Maybe the public key is Huber and the private key is the other prosecutor Q posted about today.
