You’re right, if the Senate falls to the Democrats, no conservative Justice will be confirmed. In that case, just leave the court be with seven members. There is no constitutional requirement that SCOUTS have nine justices. With its current makeup, and without Ginsburg, the court would be split four to three in favor of the conservatives. Better to leave it that way than to appoint anyone to a life time seat on the court that the Democratic Senate would allow.
