If the agent of a foreign power is a U.S. person, the government must show that the U.S. person is engaging in espionage, terrorism, or sabotage by or on behalf of a foreign power that involves a violation of a criminal statute.
I've looked and looked and can't seem to find the underlying violation of a "criminal statute" that would qualify as probable cause to spy on a U.S. citizen.

That is a most telling statement. Kinda lays waste to the entire FISA fiasco since there was no evidence of anything, anywhere that could be considered just cause.
