Sec. 948d. Jurisdiction of military commissions
The Supreme Court of the United States ruled in Boumediene v. Bush (2008) that the MCA constituted an unconstitutional encroachment of habeas corpus rights
Following debate in the House and Senate, the final law revoked Habeas Corpus protections only for non-citizens:
(e)(1) No court, justice, or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus
example, if a citizen, was picked up outside a military base, they could walk across the street and file a habeas corpus petition with the courts.
So the only way to have military tribunals is with marshal law and again I don’t see how that is accomplished without it looking like a coup. Maybe if enough of all this dirt we have uncovered would become mainstream.
Let’s not forget that the POTUS can take over the airways in a national emergency. The media spin machines would be silenced instantly when the POTUS takes the ‘air’. Under such circumstances, mil tribunals would be authorized.
I am a know-nothing is this regard, but could US citizens face military courts in a National Emergency?
In POTUS’ Dec.21 EO, I recall the words National Emergency were used.
Plus “BHO”/0bola is not a US citizen, and I have no doubt that the POTUS team knows this full well.
