I am not a lawyer but I would wonder if a military tribunal mightn't be used in cases wherein the accused were being tried for treason, sedition, conspiracy to cause rebellion, or trying to overthrow the government.

See 1408. I have trouble posting links and commenting in same post. US citizens can be classified as Enemy Combatants. I think this law still stands. I have not had to Shepardize it.
