Judge denies motion to remove Strother from Twin Peaks shootout cases(Waco)

A visiting judge on Monday denied a motion from McLennan County District Attorney Abel Reyna's office to remove 19th State District Judge Ralph Strother from presiding over two Twin Peaks shootout cases.

Noting that Strother already has voluntarily recused himself in one Twin Peaks case when he thought it was the right thing to do but he declined to do so in these cases, Judge Phillip Vick, of Denton County, denied the state's motion.

The judge also denied defense motions seeking sanctions against Reyna's office on the grounds its recusal motions were filed in bad faith and only for the purpose of delaying a defense hearing to disqualify Reyna from prosecuting bikers Jorge Salinas and Billy McCree, both members of the Cossacks motorcycle group.

Prosecutors Michael Jarrett and Brody Burks, who filed the motions to remove the judge last week, declined comment after the hearing. They filed the recusal motions only after Strother denied a state motion to delay the hearing and with witnesses with adverse testimony against Reyna waiting in the hallway.

Fort Worth attorneys Brian Bouffard and David Conrad Beyer, who represent Salinas and McCree, respectively, said the motion from Reyna's office obviously was filed only to postpone a hearing on a motion to disqualify Reyna, a hearing at which Reyna and his assistants and former Reyna assistants were subpoenaed to testify.

“Have you been read your Miranda rights ? “

No. Unlike some, I am not in a biker gang.

LOL. As the years go by you refuse to see what is staring you in the face. If the authorities were the good guys you claim they are this would have been over years ago.

Started by the bikers.. concur shxt happens.

It could have been prevented but wasn’t:

In parking lots surrounding the Twin Peaks restaurant just off Interstate 35, 16 police officers, including a SWAT team of 11, were poised with assault rifles in five police cars and two unmarked SUVs. Seven state police officers, some undercover, were inside the restaurant or nearby.

Evidence that prosecutors gave to lawyers who are representing the bikers shows local and state authorities had overwhelming intelligence that violence was likely and did little in advance to prevent the meeting.

Four of the nine people killed in a melee between rival biker gangs outside a Texas restaurant were struck by the same caliber of rifle fired by Waco police (.223). Two died from the .223 rounds the other two were hit by other rounds as well.

Bikers have criticized the way police dealt with the incident and believe the ballistics findings prove that officers made the situation worse.

“I think they handled it badly,” said John Wilson, who was at the shooting and is a chapter president of the Cossacks. “I think their first responsibility is to be a deterrent to crime, not to set up and hope they get to use their rifles.”

DUH ....

You would think that bikers would be smart enough not to start a gunfight in front of 16 police officers and a SWAT team ....

But NO! Dumb bikers!

“Clendennen: When I got out, I was in a hurry to pick my son up on his last day of school. My wife told him I was on a business trip, because he’s 4 years old and his understanding of going to jail is you’ve done something wrong.”

Dude, you did do something wrong!

“Anonymous motorcycle-club member: When you get out of jail after being gone for 30 days, you don’t have a job anymore. I got fired. Nobody wants to hire an electrician with a class 1 felony charge pending above his head.”

Who wants to hire a gangster!

Dude, this is America, not a police state.

I will give you an excerpt from the U.S. Constitution:

” the right of the people peaceably to assemble”

They could have arrested every Bandido when they crossed the county line?

“March to the sound of the guns and kill anyone who is not dressed like you”

Bandidos or Cossacks?
