Cliven Bundy to Remain in Jail – Bunkerville Standoff

The third Bunkerville Standoff Trail in Las Vegas has been delayed for several motions to be resolved before opening arguments.

Thursday saw a pre-trial detention release hearing for the four defendants, Cliven Bundy, his two sons Ryan and Ammon, as well as defendant Ryan Payne.

Bret Whipple, attorney for Cliven Bundy, argued for release of his client citing his age and failing health. The elder Bundy has noticeably weakened since his incarceration nearly two years ago.

Whipple told the court of Bundy’s dental problems, noting that the 71-year-old has had to pull several of his own teeth in his attempts to stop infections. Dental care is minimal in the CCA detention center.

Cliven Bundy’s oldest daughter, Sharee Cox, was visibly upset during the hearing and was removed by the US Marshals for shaking her head in disbelief. The Marshals have banned her from the courtroom for the remainder of the trial. She did tell her father that she loved him as she was led out of the room.

Navarro did not delay her ruling and said that his lack of respect for federal rules and regulations is one reason he will stay in jail.

Ryan Payne was also denied release quickly by Judge Gloria Navarro. Navarro cited Payne’s guilty plea in the Malheur Protest Trial in Oregon and that he is awaiting sentencing in that case. Judge Anna Brown, who presided over the Oregon case does have standing to weigh in on the issue of Payne’s release, should Navarro chose to consider it.

Ammon Bundy testified and argued for his own release and promised the court that he would abide by all restrictions and curfews set for him. Prosecutor Daniel Scheiss made every attempt to paint a picture of a man that could not be trusted. Judge Navarro delayed her ruling saying that she will give the prosecutors another chance to make their case on Monday, Nov 13th.

Ryan Bundy, who should have had a great chance at release, was also denied. Ryan made a compelling argument for his release citing the need for trial preparation. Navarro has indicated that she would like to see him be on “equal footing” with the other attorneys, as he is defending himself. Bundy, however, has not been allowed this equal footing, since he has been denied basic preparation materials, including a pen and paper on occasion.

At 71 he has my sympathy. (I'm 70 very soon.)

Not allowed to speak in their defense, observers not even allowed to shake head?

This whole thing is WAY beyond anything reasonable - he had to pull his own teeth?

This isn’t cruel and unusual punishment how?

This judge and her henchmen are as vindictive as anyone ever was. Why don’t they just cut to the chase and pull a Waco on all of them?

Of course the mainstream press doesn’t give a rip about any of it.

How in T H E Hell is this being allowed? He had to pull his own teeth? The girl removed for shaking head? Seriously? Bowe Bergdahl caused 8 men to lose their lives because he was a deserter- and he was let go- and Clive is still in prison for what? Defying the government? How many people died because of Clive again? None? Hmmm-

Lavoy Finicum was murdered- and the it’s only the grace of God that saved the other passengers in the vehicle that was ambushed and pumped full of bullets. And Clive is the bad guy? Really?

The fascist marshals, federal judges, and U.S. attorneys are the ones who should be in prison.

These men have been in prison for two years without a conviction?

Disgusting.

What right do WE have to lecture other countries about human rights violations, when it happens in America with increasing frequency?

Te more Clive is denied common decency the more anger against the government grows. The time will come when open warfare will be the only means of redress for government evil. This crap really needs to end.

As I was reading this I was hoping maybe some people will step up, start a small revolution, free the Bundy’s and take further action. This is insanity. Having a lot to lose is slowly becoming unimportant.

Has he accepted US jurisdiction, Public ownership of the lands, repaid for his grazing on the lands, and renounced armed protest against our United States? If not, then he is rightfully where he belongs. Maybe he might plead guilty, offer restitution, in trade for time served? That seems fair, presuming his cattle are off federal lands or forfeited to us.

All sanctioned by Jeff Sessions and Don Trump?

There are murderers bonding out for next to nothing.

And this “American” judge says that men who were protestors can never leave prison, no matter what the juries say (recall they were all acquitted in Oregon, where the jurors were obviously aghast at the tactics of the Comey led FBI and the Holder led DoJ).

What part of the Constitution envisions the States being 50% occupied by the Federal government? Can you think of any of the colonies that would have agreed to that in 1787?

He paid the county, which was his way of saying that was the legitimate entity. If you don't agree with that, you can't even begin to call yourself a Constitutional conservative.

My ancestors at King's Mountain, Guilford Courthouse and Alamance all were armed protestors against a corrupt government. People who worship unlimited federal power should move back to England or Canada. If the populace feels so strongly about an injustice that they feel the need to arm themselves, then the people who refer to themselves as "the government" need to consider that. It means they've gone too far and have lost their legitimacy in the eyes of the people. The BLM transformed from a aid agency to a group of radicals who viewed Western settlers as a weed to be eradicated on the way to some hippy bliss paradise where the Evil Ranchers were driven off the land. When did we vote for that?

The Bundy's may not be the brightest bulbs but Ammon made an eloquent case for himself in Oregon and won the day.

Nothing they have done should have denied them bail. If you want to worry about someone with foreign connections who might skip town, think of Judge Navarro: she has NO connection to "Our United States", since not one member of her family was here before 1960.

This is a retrial on a hung jury. It is a principal of law that a subjective decision can be made based on an assessment of the merits of a case. This is standard procedure and is why Restraining Orders are issued: an assessment of the probability of the success of a suit is made.

In this case, this has already occurred:

“On August 22, 2017, the remaining 4 defendants were found not guilty, and set free after being held without bail since 2016”

They are already on their second trial and were found totally innocent in Oregon. Yet they remain prisoners, subjected to the harshest of conditions? A responsible assessment of the case would show a high probability of exoneration. Where is Navarro’s justification? She has none. She is conducting a political persecution of men she hates, men she has no political connection to, men she has no right to judge.

Navarro should be impeached, Myhres fired, and both of them prosecuted for a malicious prosecution. The US Marshalls in this case have already shown they will resort to unwarranted violence when they crossed the line in Judge Brown’s court and threw the Bundy’s lawyer to the floor in the previous Federal trials.
