NY appeals court overturns Sheldon Silver's corruption conviction

The state appeals court on Thursday overturned the Sheldon Silver's 2015 corruption conviction for pocketing $4 million in kickbacks from a cancer researcher and real estate developers.

He was sentenced to 12 years in prison in May 2016. But he appealed earlier this year after the Supreme Court narrowed the definition of "official act" for the purposes of proving corruption cases. That Supreme Court case centered on alleged criminal conduct by former Virginia Gov. Bob McDonnell.

In Silver's case, the court ruled his jury was given a too-broad definition of what constitutes an "official act" in light of the Supreme Court's ruling, according to the ruling.

Silver was the New York State Assembly speaker for more than 20 years and one of the most powerful politicians in the state when he was indicted on a charge brought by then-U.S. Attorney Preet Bharar

Sorry Illinois and Louisiana, New York has the most corrupt state government in the country.

Yup. And we saw this coming. It’s a damn good thing that NYS will quite probably lose another House seat or 2 after the next census.

For those outside NY, The New York Court of Appeals is the HIGHEST court in the state. The NY Supreme court isn’t supreme in NY, it’s a lower court.

is there anywhere in the country where judges actually subscribe to rule of law anymore, or is knowing the judges more important than knowing the law? Just an idle question from a swamp dweller.

This is terrible, first they overturn former GOP Senate Majority Leader Joe Brunos conviction, now the former DEM Assembly majority leader shelly silver.

Either we have corrupt judges OR we are wasting MILLIONS in pretending we can clean up these corrupt governments and the corrupt politicians.

BTW, Sheely’s case was prosecuted by Preet Barrara, some walk on water prosecutor he turned out to be. Sounds like he’s nothing but a high priced waste of time government welfare slug.s

That's true and all that, but this is a federal corruption case. Where the article refers to the Supreme Court, it is referring to SCOTUS, the Supreme Court of the United states.

But according to Preet Bahrara,

The evidence was strong. The Supreme Court changed the law. I expect Sheldon Silver to be retried and re-convicted.

This is the important piece. This crook needs to be put back in jail. BTW, does anyone know if he’s been “in, or out” while he appeals his conviction? Maybe he can be “bunked” with Bernie Madoff so they can share Kosher meals together.

Well, maybe we should make the punishment fit the crime. I believe it was in China where if a manager was found to be stealing, he was shot and the family billed for the bullet.

I think regarding corruption, making it a capitol crime would clean up the system or at least make sure that recidivism is reduced.
