The student has a First Amendment right to not stand for the Pledge (West Virginia State Board of Education v. Barnette, 319 U.S. 624 (1943)). Nonetheless, the kid is a disrespectful brat. The teacher should have been informed about Barnette, but should not have been fired.

Teacher should have been informed.

In fact, I think there is a cult religion that refuses to take the pledge. Mabye Jehovah Witnesses or Seventh Day Adventists. Teacher should be aware of that possibility too.

The teacher should have been reprimanded. I don’t know what she said to the kid. But it seems like an apology from the teacher to the kid would have sufficed.

I had students who were Jehovah Witness who couldn’t pledge according to their faith. I picked them to send the lunch bag to the office while the pledge was being recited. If there were more than one, they’d just sit quietly at their desks during the pledge. I wouldn’t berate the kid. If he was the one making a big deal out of not saying the pledge, I’d just send him out of the room. The kids do have rights they don’t surrender when they come to school.
