If the 9th Circuit Court approves the RTO just thinking out loud:

1-Will the RTO more into creating rule beyond the RTO?
2-How can the 9th Circuit Court create the other Circuit Courts beyond there jurisdiction?
3-If it goes to the SC and there is no verdict, who doesn’t the President have to follow no SC ruling?

It’s a TRO.... Temporary Restraining Order....

Federal judges have a great deal of latitude....it was a New Orleans Federal Judge that stopped Obama’s Executive Order regarding immigration...

The SC won’t see this until Gorsech is seated, hence, no split order however if it was split, the lower court ruling stands.

Also, this has yet to be adjudicated, it’s only a TRO...

Another thought:

Split the 9th Circuit Court into two splint into a new court. It has already been created for legislation. Creating a new Circuit would better represent the public and be more efficient jurisdiction administration with overtimes rulings.
