The appeal goes through the ninth circuit court. That bastion of liberalism and Marxist thought. From there to the supremes. As the SCOTUS is currently configured it will likely be a tie vote... allowing the ninth circuit decision to stand. Thus the courts take another executive power away and give it to themselves.
