Federal court halts Trump’s immigration ban

The federal court for the Eastern District of New York issued an emergency stay halting President Donald Trump’s executive order banning entry to the US from seven majority-Muslim countries tonight, following widespread protests at airports around the country.

The court ruled on a habeas corpus petition filed by the ACLU on behalf of Hameed Khalid Darweesh and Sameer Abdulkhaleq Alshawi, who were denied entry to the US upon landing at JFK airport in New York City and detained indefinitely by Customs and Border Patrol. Darweesh spent a decade working for the United States military in Iraq as an interpreter and engineer and had been granted an entry visa after background checks; Alshawi had been granted a visa in order to join his wife and son who are already permanent residents of the US after their similar service with the US military.

Constitutional law professor Jonathan Turley does not see this ban as unconstitutional:

Clarification:Stay covers the airport detainees and those currently in transit. Doesn’t change ban going forward.

What I read was that this stay only affects 100-200 people who have arrived at U.S. airports. The stay prevents them from being sent back to their country of origin right away. But it doesn’t free them, either. Those people are in limbo for now.

(f) Suspension of entry or imposition of restrictions by President

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.

8 U.S. Code § 1182 - Inadmissible aliens

Take the ‘refugees’ to a detention center - expedite the processing to a few hours. Put them on planes to the airport from whence they came..

N o the ban is not halted. The deportation of two illegal aliens is being stayed pending a full hearing between the AG and the ACLU.

Illegal aliens??? They are foreign nationals traveling on US issued visas. They aren’t wetbacks or something. LOL.

On November 20, 2014, President Obama nominated Ann Marie Donnelly to serve as a United States District Judge of the United States District Court for the Eastern District of New York.

On October 20, 2015 the Senate voted 95-2 in favor of final confirmation.

Ann M. Donnelly (left) is sworn in by Chief Judge Carol Bagley Amon as the 61st judge in the history of the Eastern District of New York during an investiture ceremony at the federal courthouse in Brooklyn.

This is one of the major battle fronts for Trump to address: the rebuilding of the courts into a newly constitutional branch of government. His agenda, our agenda, will always be stunted until he does.

This is NYC we are talking about. You can’t rip a fart without a lawyer smelling it. The place is crawling with them.

i watched this unfold on twitter. A reporter in the NY/NJ airport, airport told reporters to leave, reporter tweets for they will not leave. Argument begins as to whether or not airports belong to the public.

Nadler tweets, headed to airport, ACLU tweets they file suit, twitter comes alive with the ignorant bigoted leftists and democrats.

Within a half hour protesters arrive, tweets go out for everyone to go to any airport near them to protest, news media tweets begging for anyone stopped to contact them, lawyers tweet offering to assist pro bono to anyone.

These people disgust me. We won but they still wield a bigger crowd and louder voice. I hope Trump doesn’t give one inch!

Kit, judge has no right to be involved, yet my sense is that his order will be followed as if he does have that authority.

Bottom line for me is, this is coming to a head now. We have Patriots whose leader is trying to rescue this country, and well-financed tyrants who will NEVER give up trying to stop us. We can not be unified because neither side will give up.

Therefore, my sense is we are indeed headed toward civil unrest and eventually open warfare. That is what they have shown that they want, from the start when they attacked DJT rally goers, to now.

Thank God the patriots didn’t take their bait under the Obama Administration, as he would have sent in his people to kill us.

I don’t think open conflict can be avoided as they will never give up trying to take away our freedoms and country.

Thank God we now have President Trump, who has our backs and is the best Patriot with which God has gifted to us.

But, it is going to get much worse before it gets better. That’s just my opinion.

“The court’s stay is temporary and only affects people currently detained and those in transit.”

Correct!

A federal judge blocked part of President Trump’s executive order on immigration on Saturday evening, ordering that refugees and others trapped at airports across the United States should not be sent back to their home countries. But the judge stopped short of letting them into the country or issuing a broader ruling on the constitutionality of Mr. Trump’s actions.

This won’t change anything. The judge is judge bending to those with valid green cards stuck at airports today.
