I would suggest a third possibility: the e-mails contain the real smoking guns, so sensitive that HRC wanted them sent to/from an account outside her own e-mail domain, one she believed that investigators would never locate.
And here’s another conspiracy theory to contemplate. I believe Anthony Weiner led them to the e-mails. His career is over; he’s a public laughingstock, he’s facing serious charges and his former friends (and soon-to-be “ex” wife) in the Dim establishment hung him out to dry.
The FBI was leaning on him for the sexting scandal and he played the only card he has. Unfortunately, he’s setting himself up to be the Jim McDougal of this generation of Clinton scandals.
Here’s my entry into the theory sweepstakes:
Hillary’s claims about not sending any messages “marked classified” gave away that she knew the markings were an issue, and that she believed they had been excised. But the actual process of excising the files has remained a mystery. Theory: Huma put classified data on the recently seized laptop, and used software (perhaps provided by Bryan “Fifth Amendment” Pagliano) to strip the headings and anything that stopped non-secured systems from printing the messages. She printed and gave Hillary hardcopies, and/or forwarded the cleansed files through the private server. Huma also probably directed traffic for Clinton Foundation graft.
Hillary’s lawyers identified all such files, deleted them, and bleached her private server hard drive. Huma probably deleted the material on the laptop, but didn’t bitbleach the HD. FBI techs restored all the deleted contents of the laptop while looking for evidence of Weiner pedo-depredations. Oops — they stumbled on a complete trail of the server, including before and after files revealing lots of intent. Hillary will try to dodge, and claim she didn’t know.
