He can be indited if new evidence come to light and he doesn’t IMMEDIATELY report it.
Plus I think the VAST majority of the FBI hate her and maybe he was pressured.

I think Comey is first and foremost a politician. (Anyone who rises to the cabinet level in the civilian world, or to full colonel or above in the military is more politician than worker.) He is fighting a pitched battle within the FBI to keep the agents contained and off balance until the election is over. The abrupt and startling news conference he gave a few months ago where he outlined the case for indictment and then said no reasonable prosecutor would indict was actually an attempt to cut off the agents under him from using the NSA to obtain proof that Hillary lied during her interview. Apparently, that worked. He prematurely closed the avenue of a possible Hillary indictment.
Now, there is more internal politics and he is trying to do damage control. But, the question is; is the damage control to protect him or Hillary?
