Noisy neighbor - gas station TV and music

My brother lives on a residential block zoned commercial. On the next block is a gas station that has just installed tvs next to the pumps and started playing music 6 am to 10 pm "to attract customers." It's cranked up LOUD about 150 ft from his house. He works at home and spends a lot of time working on his house and yard and the noise is making him miserable.

He's spoken to the gas station owners, no luck, and to the town - no noise ordinances in commercial zones.

Any suggestions?

I've never seen gas pump TVs. Is it a southern thing? Do they really attract customers or does the TV company pay the station, to get advertising revenue?

The TVs at supermarket cash registers already annoy me - who thinks, hey let's go to Bill's Pump N Snack and we can catch up on the News N Ads? I

Sadly, the kinds of customers that will be attracted by loud noises and shiny things aren’t people you want. Most of them won’t be up that early. Thing large groups of ‘teens’ hanging around doing some flash shopping.

I would keep bringing it the case of the owner. Chances are the worker inside the store doesn’t want to hear it either. Failing that bring it up to the franchise. Bring it up to every supplier including the beer distributor, the chip distributor, the gasoline distributor, etc. Failing that lobby the city for a noise ordinance because the noise is traveling in to a residential area. If the owner is a jerk he will understand losing money.

Not a lawyer but...I remember a law class years ago discussing torts and the “right of quiet enjoyment” of your property. Sustained loud noise would be a tort violation for which he could go to civil court for a remedy. The action does not have to be illegal to be a tort violation.
Think of the citizens s who were able to make the city remove city owned windmills because of the noise.

Unfortunately he has pretty much zero recourse. The time to get out was when the owners of the gas station applied for their building permits to install that junk.

Feel bad for him.... maybe he might get struck by Jewish lighting and catch a break.

I passed a gas station in a bad neighborhood today. I heard classical music and assume they play it to keep the rap riffraff away.

I once heard about a guy who got ripped of by a gas station and they wouldn’t make it good. He called a local building supply company and told them he was the station owner and they were replacing the tanks. He would need 50 yards of sand delivered and asked them to dump the sand in the driveway to stay out of the way of the repair crew.

Just saying.

Several have suggested setting up a sound system and playing various things. Along that line, how about some Jimmy Carter, Al Gore, or John Kerry campaign speeches played with the volume up.

Common law nuisance violation. Sue the gas station in small claims court. Should cost about 30-$40 to file. Most judges, especially in small towns, still recognize English common law.

Do not. I plead with you, do not have your brother do any of the suggested activities that would damage the property or deliberately drive customers away. He would find himself in very big trouble. The kind with $$$ signs attached.

He does need to document the noise levels and how often they go above a certain decibel. If he can get a physician to document that he is suffering from stress because of the noise that will also be good. Establishing work hours lost because of the nuisance is also important. There are legal remedies.
