Tim Kaine, who will not actually be the Vice President because neither he nor Hillary have been inaugurated, cannot assume the Presidency

If the President elect has died or has not qualified, the Vice President elect shall serve as President (XX Amendment §3).

Other than that, Mrs. Lincoln, how was the play?

If a president dies or withdraws from their obligation to serve as president before the electoral college meets, the electors would be free to cast their ballots according to their conscience and could theoretically elect whom they wish. If they fail to elect someone by majority vote then the House of Representatives would elect the next president. If the death or refusal to serve comes AFTER election by the electoral college then the Vice-President-elect would become President.

The real constitutional crisis would come if BOTH the President and VP elects died or were in some way prevented from becoming President. I should note that most constitutional scholars believe that no court can prevent a lawfully elected President from discharging the duties of their office. Congress alone can remove a president and only by impeachment.

Criminal indictment would not bar any lawfully elected person from assuming office, though their term might be very short.

The original president for succession was President William Henry Harrison who died of complications of pneumonia about a month after taking office in 1841. He was succeeded by his Vice President, John Tyler.

Rumor was he contracted the illness during his campaign.

More likely is a scenario where the election is suspended due to “Terrorism” and Obammy declares Martial Law and says he must stay in office until such a time as the election can be “safely” rescheduled.

Sound far fetched?? In today’s Washington I think not.
I would even expect Republicans like Lindsey and Ryan to openly support Obama. Media and Supremes wouldn’t do a thing to to it.

Of course you can put an indicted person in the Oval Office. Who’s going to stop them - congress? They already put a fraudulent, not natural born citizen in there and congress, the military nor the Supreme Court did jack about it.

Being indicted does not negate the 20th Amendment which says that the President-elect becomes President on Jan 20th. Congress would shortly thereafter find the President unable to discharge the duties and Kaine would act as President.

Obama did say in July of 2008 that he would be President for “the next 8 to 10 years” so I do believe that plans have been afoot this whole time to keep him in office, but I think it would involve a situation where a new POTUS CAN’T take office. Possibly an EMP attack.

In today's environment just about anything is possible. Just about anything, "enemy or domestic" is possible. Nothing can be considered too audacious or too outlandish.

Just about anything is possible and nothing would surprise me.
Nothing.

Question should be; If what we thought was impossible yesterday actually happens tomorrow, how will "the people" respond...and how will "the establishment"/"the street" respond in return?
