If the argument was the certification was due to false pretenses (i.e. fraud), then does that open up other possibilities?

For example, if he was falsely certified due to fraud, then he was not legitimate and the actions he took were not authorized.

So, going with this, someone who did not have proper legal authority deployed US military forces to engage in acts of war, resulting in the deaths of US and foreign citizens. Isn’t there a legal term that describes the unlawful taking of another’s life? What is the penalty for that?

Could that kind of conduct fall into the “crimes against humanity” area that was used to bring certain leaders of the Yugoslavian civil war to justice?

Sure, Congress could impeach and remove him from office.
