Under the 20th Amendment, the new Senate will be sworn in on January 3 and the new President will not be sworn in until January 20.
That means that regardless of who wins the Presidential election, if the Democrats retake the Senate then Senate Majority Leader Chuckie Schumer will have over two weeks to easily confirm every single Obama nominee, from Supreme Court down to the district courts.
Be afraid. Be very afraid.
Your scenario is precisely the one I expect to transpire: Schumer and Obamao have a fortnight to wreak havoc. It is what they do. Of the Dem seats listed I do not expect the Pubs to take either NV or CO. Of the Pub seats listed I expect the Dems to take them all except for AZ and OH. Kirk is toast in hard left Illinois. Johnson is toast in hard left Wisconsin (Walker is not a conservative, he is a functionary who makes the trains run on time. No coattails in this one). Ayotte is toast in now hard left New Hampshire, and her squishiness will not inspire any TEA Party support this time. Toomey is toast in damaged and increasingly leftist Pennsylvania. Florida is lost thanks to the fecklessness of Rubio. MO may not be lost but I doubt the Pub has any staying power. If he wins it will be in spite of himself.
I truly hope I am surprised the Pub candidates are dreadful. Even McCain and Portman.
