1968 Election Year precedent: Let the new president fill Supreme Court vacancy

The last time there was a vacancy during a presidential election year was 1968, when Earl Warren decided to retire and Lyndon Johnson tried to elevate Abe Fortas to fill his seat.

A great political firestorm occurred. It was decided that whoever was elected in November would appoint the successor.

Nixon ended up appointing Warren Burger to replace Earl Warren.

That is the only course of action is to force the senate to stop action on this BEFORE it starts. Dont even get the gears started.

Ted Cruz has the bully pulpit right now, and so does Marco Rubio. It's called the GOP debates, and there is one tonight. Let's see if Cruz and Rubio together can lay down a line in the sand that McConnell dare not cross.

If this is really the GOP year, then Rubio (even more than Cruz) must demand that the Senate leave the seat vacant for one of them on the stage to fill.

To do otherwise would be a betrayal of all Republicans by the Senate Majority Leader. Both Rubio and Cruz must say that. Tonight.

Cruz and Rubio are fellow Senators with McConnell. They must be the ones to question where McConnell's loyalties lie, and make it toxic for McConnell to do anything but lay the groundwork for the next Republican President, not for Obama.

They have to be the ones to ask their fellow Republican Senators what team they're playing for.

That was then, and this is now. Obama’s going to nominate someone as fast as you can imagine (Jarrett’s probably had the paperwork in a file for quite some time), and McConnell’s going to grab his knees and bend over backwards to fast-track the new Justice.

This isn’t your father’s political environment any more.

Yep, the Republicans should make it clear right now, that there will be no new Supreme Court Justice until after the election.

That was different... he announced his plan to retire in 1968, but stayed on the bench until July 1968.

McConnell isn't that stupid. If the Republicans buckle on this one then they're going to lose not only the presidential election but every close Senate election ... because conservative voters are likely to stay home in disturbingly large numbers.

I think this turn of events is going to have stronger implications on the Republican presidential race than anything else.

Better yet. Let’s just do away with the so called Supreme Court. It’s just loaded with a bunch of biased political activists now anyway. Let the American people make the decisions what is “constitutional” and what is “unconstitutional”.

Abe Fortas was a crook, IIRC.

Of course, Warren Burger was a disaster. He said he thought Roe v. Wade would REDUCE abortions. He lived to regret and repent of that vote.

Burger’s daughter was a pious Catholic. He died praying, and clutching a Rosary.
