The common law allows for exceptions to the Jus Soli principle. McCain was still born into the jurisdiction and allegiance of the US. Anyone with even a basic understanding of the the common law understanding of NBC would know that he was a NBC. George Romney was not a NBC. I agree with you there. Goldwater was born in the Arizona territory which was fully subject to US jurisdiction. Goldwater was born into US allegiance and was a NBC. Donald was born on US soil. Obviously a NBC. Rubio is questionable as well. It could go either way there. The common law would make him a NBC however regardless of his parents’ status.

Who changed the law? I was born in Germany, of two US citizen parents. I am not nor will ever be natural born. Only two US citizen parents birthing a child on US soil is natural born. I was born a citizen but NOT a natural born citizen. I do NOT have a born in the USA birth certificate.

Just think, if Rubio (born on US soil to non-US citizens) is a NBC, doesn’t that open up some horrible possibilities?

If Kim Jung Un or the head of ISIS were able to smuggle pregnant women across the Mexican border and they gave birth in El Paso, in 35 years those North Korean Communists or Middle Eastern jihadists could be eligible to be President (not that you could really tell the difference with what we’ve got in the White House now).

I’m having a tough time thinking our founders, who did such a great job with the Constitution, would have allowed such a security hole that would allow Presidential eligibility to be hacked so easily. In my view the more restrictive view of NBC (on US soil to US citizen parents) seems like the right read of the text, but what the heck do I know. It would be nice to get this argument properly settled through the court system.
