I read about this possibility on another board.

One of Rove’s plans:

1. GOPe back Cruz.
2. Cruz wins.
3. Dems file suits, Judge-shop for Lib judges
4. Judge rules Cruz ineligible (regardless of whether he is or not)
5. Power to select alternate candidate reverts back to Rove/GOPe.
6. Rove picks...............JEB!

Well, with the recent GOPe endorsements Trump has gained, #1 in that theory is becoming suspect.

1. Bloomberg runs Independent as write-in.
2. Biden runs Democrat as write-in after Hillary wins primary then drops out.
3. Trump wins primary but then does not win majority of the Electoral College after weeks of manual ballot counting.
4. Trump dies of a massive heart attack (his doctor lied).
5. Biden has a brain hemorage (finally).
6. House and Senate must select Bloomberg as prez.
7. Pepsi and Coke go bankrupt.
8. Diabetes is cured.

GOPe or RNC don't need a court order to disqualify Cruz. They can do that on their own. If Cruz doesn't like it, he can sue them.

Just saying, the party is its own competent "judge" of eligibility.
