I'll probably get lambasted for this question, but I'm truly looking for an answer. Why couldn't the judge of the next small town Hillary is in, issue a warrant for her arrest? Isn't there enough evidence obtained in FOIA findings to charge her with something?
Because judges don’t issue arrest warrants on their own. A prosecutor has to bring charges first (and, in the case of Hillary, any potential charges would be federal, so state judges wouldn’t have jurisdiction anyway).
Jurisdictional issue.
It would need a federal prosecutor and judge to pull their heads out and actually do something other than pick their noses.
The Top Secret e-mails are enough.
The people who down loaded the material from classified systems, stripped it of its markings, and uploaded it to an unclassified system and then transmitted it, committed a serious felony.
...and they certainly didn’t do it without clear direction from Hillary.
This is an FBI matter, and they’ve likely had their hands tied.
Local cops can’t act without a warrant.
The way it works, at least in Florida is:
The police investigate a crime. They make a recommendation to the local prosecuting attorney. The recommendation says what law was broken and what evidence the police have that a particular person has broken that law. The prosecuting attorney then decides whether to take the case. This can be a political decision. For example, Democrats in my location are pretty much not gong to be prosecuted for crimes that don’t involve blood and plenty of evidence. Or, a prosecution decision can lie in other realms. A serial killer or a serial criminal is likely to be prosecuted. Another factor is whether the community can afford the prosecution. Some prosecutions cost more than the tax basis of the entire community.
It is unlikely that the local police will have any evidence or access to evidence against somebody who is not a local resident.
Routinely, crimes that are very difficult to prosecute, like many white collar crimes, are not prosecuted for a variety of reason. They don’t make headlines. They are difficult to prove. Most of the potential jurors don’t see them as actual crimes. Hillary would be a tough prosecuting from all aspects.
Hillary’s crimes violated federal law, and under today’s gargantuan FedGov, some animals are more equal than others.
Another issue, beyond what the other poster’s have mentioned, is the Secret Service. To arrest Hillary would require getting the Secret Service to allow you to. It would take a massive coordination and they would probably only allow the FBI to do it and even then, it is unlikely. You simply can’t arrest an elite in this culture. We’re talking about a woman who can yell at the president, “Call off your f*cking dogs!” That’s about as elite as you can get. How many people can call for and get a meeting with the President?
To arrest Hillary and probably even a Republican presidential candidate, would need a presidential order.
You mean like Travis County and Rick Perry/Tom DeLay/Kay Bailey Hutchinson?

As for that matter. Why not the ID THIEF in Chief? Is it, or is it not a felony to use someone else’s SS number?
In this case the law is irrelevant. She is the modern day equivalent of Al Capone. She will never ever be indicted for her crimes. They might get her on a speeding ticket or some such nonsense.
How could Hillary break the law, she is a lawyer don’t you know?
I've always had the impression that top decision factors for most prosecutors are:
1. Is there a good chance that prosecuting this case will maintain my 99% conviction record?
2. Will prosecuting this case help my chances for reelection?

Jurisdiction. The United States Attorney of New York has historically been given discretion and leeway on crimes involving financing and Charity foundations.

Guess again. Some SS agents who have been assigned to the Hillary detail have stated, under promise they could remain anonymous, that working for Hillary is not a job, it’s a form of punishment. They hate her. Some of the comments made were pretty amazing...
She and Bill would get off the helicopter, walk to the White House holding hands, smiling for the cameras, yeah that nauseating fake smile of hers...get on the elevator and the screaming match would start. One said he had been in the military for 25 years ad never heard a woman with such a filthy mouth.
One said he would walk in and say good morning, Hillary would scream F^&K OFF.
More than one said she was cold, callous, obnoxious, insulting...
I think the Secret Service would help you put the handcuffs on her.
I’m not sure who would actually have to do up the indictment, maybe a federal grand jury? But I’m pretty sure the White House Sergeant at Arms could arrest her for almost anything. As long as he was sure he could make it stick...But he would probably have to have orders from on high. And she would have to be physically in the White House at the time.
Any other time, FBI agents or US Marshalls could arrest anyone.
At the local level, the earlier comments are correct, jurisdiction. They could feasibly arrest a person for federal crimes, but an indictment would have to be issued first. As long as no indictment has been issued, no local cops can arrest her unless she commits an offense in their jurisdiction.
If the FBI finds anything, all bets are off, even Hillary probably can’t escape arrest if they find serious illegal activity.
The way it looks right now, from what I’m hearing today, new emails have been found that might be work related, among those that were deleted. That makes an indictment more likely. So far, her political power is probably the only thing keeping her out of jail. If it’s true they have caught her lying yet again, and she deleted work related emails, especially pertaining to Benghazi, I’m betting she’s really worried.
I’m wondering how long it will be before the DNC will demand she remove herself from the ballot. She’s causing them to look bad and virtually every day it gets worse. It can’t go on, they will have to do it at some point.
