Study: Non-whites more exposed to environmental hazards

BERKELEY, Calif., Sept. 17 (UPI) -- According to a new study, published in the American Journal of Public Health, African Americans and Hispanics are more exposed to health risks like air pollution, toxic waste and a lack of green space.

The study -- a tag-team effort between researchers at the University of California, Berkeley and the California Environmental Protection Agency -- used a new online tool that maps environmental health hazards.

One question arising from the article you incorporated.

A minimum of 10% and up to 25% of the cap and trade funds collected can be spent on disadvantaged communities. Do you have any information as to how much that is (in $)? What exactly is the other 75% being spent on?

My notes on SB 862:

States Cap and Tax law (AB 32) designates the State Air Resources Board (ARB) is charged with greenhouse gas compliance.

Existing law requires the ARB to collect money from manufacturers, except fines and penalties, thru auctions and deposit that money in the Greenhouse Gas Reduction Fund and makes that money available thru appropriation by the legislature.

This bill, SB 862, establishes the CalRecycle Greenhouse Gas Reduction Revolving Loan Program.

SB 862 authorizes the Department of Resources Recycling and Recovery to provide loans and grants to reduce greenhouse gas emissions by controlling infrastructure to process organic material and recyclable material.

This bill, SB 862, transfers $10 million from the Greenhouse Gas Reduction Fund to the CalRecycle Greenhouse Gas Reduction Revolving Loan Program Fund.

(2) Existing law established the Department of Community Services and Development (just like Obama in ACORN) and provides energy assistance too non-White or Asian people.

This bill, SB 862, uses that money to also insulate homes.

(3) Existing law took $500 million from the Greenhouse Gas Reduction Fund and lent it to the General Fund.

The 2008 Prop 1A (HSR) created the High Speed Rail Authority.

SB 862 takes $400 million from the $500 million the Greenhouse Gas Reduction Program Fund has and gives it to the General Fund who in turn gives it to the HSR for 2015-16 fiscal year.

The loan would have to be repaid depending on the need of the HSR project.

The loans to the HSR would continue indefinitely.

SB 862 will continue giving 25 percent of the GreenHouse Gas Reduction Fund (Cap and Tax, AB 32) to the HSR beginning 2015-16.

(4) SB 862 created the Transit and Intercity Rail Capital Program administered by the Transportation Agency to expand and integrate all rail services.

SB 862 awards grants by the California Transportation Commission appropriated for the GreenHouse Gas Reduction Program Fund.

SB 862 will provide 25 percent of the needed money for green projects in non-White or Asian communities.

The bill will use the Transportation Agency to select projects.

The bill guarantees 10 percent of the annual tax income from the Gas and Tax law (AB 32).

SB 862 establishes the Low Carbon Transit Operations Program to provide green public transportation to non-White or Asian communities.

SB 862 requires the Department of Transportation to coordinate with the State Air Resources Board (ARB) to establish documenting requirements.

SB 862 requires the Department of Transportation receive 5 percent of the GreenHouse Gas Reduction Fund (Cap and Tax, AB 32) beginning 2015-16.

(5) The State Treasury and Energy Efficiency State Property Revolving Loan Fund holds the money received by the State Energy Resources Conservation and Development Commission under the federal American Recovery and Reinvestment Act of 2009.

The money is used for federal State Energy Programs.

The money is dispersed by the Department of General Services for loans for projects on state-owned buildings.

The money paid back comes from energy utility rebates.

SB 862 establishes the Energy Efficiency Retrofit State Revolving Fund under the State Treasury. The money will be used in state-owned buildings to increase energy efficiency and install solar panels.

(6) The Strategic Growth Council awards and loans money to the development of sustainable communities as described in the United Nations Agenda 21.

SB 862 adds two members to the Strategic Growth Council, one appointed by the Speaker of the Assembly and the other appointed by the Senate Committee on Rules.

“The bill would require the council to develop and administer the Affordable Housing and Sustainable Communities Program to reduce greenhouse gas emissions through projects that implement land use, housing, transportation, and agricultural land preservation practices to support infill and compact development and that support other related and coordinated public policy objectives.”

In the above paragraph a sustainable community is high-density housing of 20 units per acre with the continued availability and use of at least 49 percent of the housing units for very low, low-, and moderate-income households with an affordable housing cost or affordable rent, as defined in SB 375. Public transportation within one half mile of households accessible by walkability and bicycle paths. “Infill” as it is being used is to make use of undeveloped land within a community for either community gardens or housing. “Compact development” means high density.

SB 862 will continue giving 20 percent of the GreenHouse Gas Reduction Fund (Cap and Tax, AB 32) to development of sustainable communities beginning 2015-16.

(7) The Z’berg-Nejedly Forest Protection Act of 1973 prohibits a person from conducting timber operations on timberland unless a timber harvesting plan has been prepared by a registered professional forester and has been submitted to the Department of Forestry and Fire Protection and approved by the Director of Forestry and Fire Protection or State Board of Forestry and Fire Protection. A violation of the act is a crime.

I’m not going to outline the forest part of this bill.

(11) The Air Quality Improvement Program is administered by the State Air Resources Board (ARB). The state established the Clean Vehicle Rebate Project to promote the production and use of zero-emission vehicles and the Hybrid and Zero-Emission Truck and Bus Voucher Incentive Project.

The Air Quality Improvement Fund of $30 million is spent on the Clean Vehicle Rebate Project and the Hybrid and Zero-Emission Truck and Bus Voucher Incentive Project.

SB 862 takes unused money and gives it to the Vehicle Inspection and Repair Fund.

(12) The law takes money collected by car owners and helps repair cars that fail smog inspection.

SB 862 takes $15 million of that money and puts it towards the Clean Vehicle Rebate Project. It is used for rebates on electric and hybrid vehicle purchases.

(13) Law requires a state agency using the Greenhouse Gas Reduction Fund (Cap and Tax, AB 32) to keep records on money spent.

SB 862 requires the State Air Resources Board (ARB) to develop guidance in reporting.

(14) The law requires the California Environmental Protection Agency to identify non-White or Asian communities to give money to.

SB 862 requires the California Environmental Protection Agency to work with the State Air Resources Board on requiring one public workshop before identifying the non-White or Asian communities that will receive funds.

The law requires the Public Utilities Commission to make contracts or taxes with non-utility producers of solar or wind electricity producers of no more than one megawatt.

SB 862 will extend the contracts to the Department of Corrections and Rehabilitation with a capacity of not more than 8 megawatts and the export of not more than 1.35 megawatts of electricity generated by wind.

(16) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.
