It is definitely a cause for arrest in NYC. So is putting your bag on an empty seat, or doing anything that uses more than one seat per rider.

It makes sense that one could be arrested for taking up two seats on a train, bus, or whatever.

But the objection here was purely a religious objection! Evidently, no muslim can sit on a seat where a shoe has been. I guess the seat has been defiled in some way.
