Freddie Gray's Previous Attempt To Injure Himself In Previous Arrest Withheld From Defense

Prosecutors have information indicating that Freddie Gray "attempted to injure himself" during a previous arrest, but have intentionally withheld it from their criminal case against the six Baltimore police officers charged in Gray's apprehension and death in April, the officers' attorneys said in a court filing Thursday..

"Based upon information and belief, the State's Attorney's Office was informed of this fact, yet failed to disclose to the Defendants any statements, reports, or other communications relating to this information," they wrote.

Gray, a 25-year-old Baltimore man with a history of arrests, died in April after suffering a severe spinal cord injury in a police van. Six officers who were involved in his arrest and transport on April 12 have been charged with violations that range from misconduct in office to second-degree murder

Defense: Mosby either failed to turn over Freddie Gray evidence, or independent investigation didn't happen.

All of the officers have pleaded not guilty; a trial date is set for October. In the meantime, prosecutors and defense attorneys have been battling through pretrial motions and other filings.

In their filing Thursday, the defense attorneys said prosecutors have withheld "multiple witness statements from individuals who stated that Mr. Gray was banging and shaking the van at various points" after his arrest April 12, as well as "police reports, court records, and witness statements indicating that on prior occasions, Mr. Gray had fled from police and attempted to discard drugs."

A spokeswoman for State's Attorney Marilyn J. Mosby declined to comment. But in a court filing, prosecutors have said they gave defense attorneys all the evidence to which they are entitled last month as part of the discovery process.

Problem is, according to headline, the fact exists that the DA withheld information vital to the DEF from the DEF.

In reality, the DEF claims (in a legal motion) that the DA withheld such information.

In a legal and practical sense, it’s very important. Please understand, I’m not trying to break your chops. It’s just that at FR, one of the last conservative bastions of truth in a trashy liberal world, we need to get important things like this correct.

Had the headline been correct, it would have been a huge blow to DA both personally and in this case.

In reality, it’s just another set of lawyer’s claims. Reality will tell if it’s the truth.

Possibly short correct headline: Defense says DA hid fact Freddie Gray tried to hurt self in prior arrest

But that was not the headline at the link, and there is a very significant legal difference.

It is the same difference of a criminal charge by a DA and a finding of guilt by a judge and jury. One is an accusation, the other is a finding of fact.

Let’s all work together to not repeat other’s foolishness/stupidity.

I’m sorry that I did not meet your standard. I assume most Freepers are capable of reading the material on their own and reaching their own conclusions. I have heard lawyers make statements to judges in much the same way my article headline read, and , in fact, the attorney’s in this case did that in their motion. Don’t get your panties in a wad and make a mountain out of a mole hill.

It’s not my standard. It’s the standard of truth and accuracy.

Imagine if someone sued you claiming you were drunk and raped a woman, and let’s say your name is Fred Doe,

“Fred Doe gets drunk and rapes a woman:

is a very different newspaper headline than

“Lawyers claim Fred Due got drunk and raped a woman.”
