I would have hired this guy even if I could find an American who was willing to work for less pay.

You just damned yourself with this statement. He is NOT perfect for the job ... I don't care if this H1B can walk on water he's a foreigner .. to be used ONLY if you can't find an American who can do the job. You are by your own words a BIG part of the problem.

I don't understand how the company comes out ahead if they're doing it the way you've described.

The way I interpret it, if you were a company, which would you hire - an H1B who worked that way but you paid only for 40, or a U.S. worker who expected to be compensated accordingly?

Evidently those outfits (in Texas, in the '90s) were doing that to capture the market. It was no skin off their nose if they worked their people ragged - there was always more coming in.

I always made a point to tell those guys what I made in the hope I could stir up some trouble. Dunno how successful I was as they told me they were trapped - the Mother Ship kept all their papers so they couldn't work anywhere else.

To continue ... H1Bs BY THE LAW are to be used ONLY if you can’t find an American who can do the job. NOT an American who can do the job better. The H1B is NOT here to compete with the American worker but to fill in ONLY if you can’t find an American who can do the job AT ALL. AND the children born in the USA to immigrant parents ARE Americans.

Do only losers and corporate whores have advanced degrees in engineering, get licensed to practice in multiple states, serve on industry advisory boards and in leadership roles for professional groups, and run engineering companies?

I get what you're saying.

My point was that the company doesn't really come out ahead at all if they work the guy for 80-90 hours per week but only bill the client for 40 hours. If that's the case, then why not have him work 80 hours and then bill two different clients for 40 hours each? The cost to the company would be the same, and the revenue would be doubled.

Maybe I'm just missing something here ... or maybe there are some important details that aren't included in the post I was citing.

All three of my IT guys are American -- and as far as I know, their families have been in the U.S. for at least three generations.

I have a few employees who you might consider "Chinese" and "Indian" ... but they are all U.S. citizens of Chinese and Indian descent. None of these are IT professionals.

When it comes to my company, you take just about any prevailing wisdom about immigrant workers in U.S. companies and throw it out the window -- because that's simply not how we do business.

Sorry for delay - grandkids here - bloody zoo.

To the matter at hand:

IMO I think it was a dodge to get around the “same pay as an American” rule.

It would be no sweat on their part to put the guy on salary (same annual wage as an American), then work him extra but bill the client only for 40 hours and get an edge on the American contracting companies, who usually paid their programmers by the hour and paid overtime (mine did).

When I retired, I let them know that I’d be availavle for short-term gigs (three months or less - not popular), but soon after they went out of business. At that time 1990s, the H1Bs were flooding in and I guess they wouldn’t/couldn’t compete.
