You should always verify the receipt and deposit of the earnest money. If the buyer does not deliver the earnest money as promised, they are in violation of the contract and you can break it.

If a buyer allows a time period to expire, without signed acceptance, that is the same as rejection of your counter-offer and at that point there is not a contract. Sorry, but the property was never in contract and the deposit will be returned to the buyer.

Great observation. Honest brokers are a blessing but they are as rare as honest used car salesmen. I refer to them as property pimps.
