An emergency room nurse who treated a fellow nurse who contracted the Ebola virus in Dallas is taking time off and retained a noted Fort Lauderdale plaintiffs firm rather than return to work.

Briana Aguirre, 30, contacted Robert W. Kelley of the Kelley/Uustal firm after concluding Texas Health Presbyterian Hospital was not adequately protecting staff from the lethal virus, Kelley said.

With Kelley by her side, Aguirre was interviewed Thursday by Matt Lauer of NBC's "Today Show." She told Lauer the biohazard outfits given to nurses left a 3-inch gap below the chin that potentially allowed contaminated fluid to travel to the mouth and nose.

What kind of face protection did they have? I think that should be of equal or greater concern. Aerosolized, virus contaminated bodily fluids from sneezing, coughing, projectile vomiting, explosive diarrhea can stay suspended in the air for a long time and a face shield and N95 mask is not sufficient protection.

Oh, and without someone threatening some type of consequence, how many more people are we going to have to treat and pray they survive?

Telling the nurse, who was running a fever, it would be ok to board an airplane. Really?

I do not think the CDC knowingly put anyone at risk. I think everyone is learning as they go.

Only have to prove simple negligence to win. This case is going to be a slam dunk for the plaintiff.

Also interesting to note that the CDC quarantines monkeys and birds for 30 days... specifically mentioning to prevent the spread of diseases like Ebola.

The article said she hired the firm rather than return to work. Seems she doesn’t want to be fired if refusing to be put at risk by going to work.

Being a Nurse, she noticed the gap under her neck, why did she follow through with care for the patient? I would of found something to cover my neck, wrapped another gown around my neck and used medical tape....

At this point I think all lawsuits are tacky. It will be much harder to fight the disease while fighting lawsuits and obsessing over every failed step.

Interesting you sign up this week to give cover to this administration and how they are handling this situation.

The big news though was the CDC officials were there at the Dallas hospital running the show.

That has not been reported anywhere else.

I detest BS lawsuits as much as any patriot, but at a minimum the CDC's actions have been criminally negligent. On the other hand I find it hard to believe that our Fed Gov could be so totally incompetent. The whole thing is one big cluster ----. This could be part the Muzzie buttboy's end game plan for the one world caliphate.

sWe are now facing a perfect storm. World economy on verge of collapse...radical Muslims with chemical and nuke weapons on the march...Russia and China rattling sabers...Ebola and other disease imported by our government...racial hatred fomented by the Obama administration. What a better way to destroy Western civilization...wipe out hundreds of millions of people, wipe out 100s of trillions in debt..and install a new government over all that's left.

the government?... Also the laws in Texas DO NOT take a hankering to
law suits!,,, The hospital followed protocol dictated by the CDC I hope this
nurse can afford to be without work for a VERY LONG and extended period of time!!!!!!!

yes me too but i’ve studied enough to give up. and i think you can still sit at the bar by studying on your own. but this might be old. most states probably closed that gap to ensure no common sense people apply. and law schools don’t prepare for bar exams. and there are enough legal links that you can actually read a lot of case law and in so doing see what the current opinions of the men in black dresses dictate which is the current substitute for law. I know enough and maybe more than some lawyers on basic contract and personal stuff. I paid my first lawyer $1000 for my incorporation and i had to explain to him why i needed to do it under the 1986 fed changes. my later omain concern at the time was IRS stuff why are we where we are.
I got a lexus subscription by lying about being an attorney and got an eyeful. there is an entire database called assets.

The liberals have figured out Obama is going to lose on this issue, so their trial lawyer constituency believe they now have the green light to cash in.

CDC and hospital botched this. But that doesn’t mean that collectively we all need to pay this nurse $1 million dollars in emotional distress.

Now if she does get actual Ebola from this, at that time I’d change my opinion on damages.
