Wal-Mart says actor-comedian Tracy Morgan and other people in a vehicle struck from behind by a company truck on a New Jersey highway in June weren't wearing seatbelts.

People have been killed by people in the other vehical flying through their windshield following a collision. Bodies can become ballistic missiles in collisions.
Think of it as securing a load.
Hmmmmm, do they have seat belts on those scooters in Wally World and do they require the 300 plus pound occupants to wear them? How about a vision and driving test for anyone asking to use one? Even at low velocity the combined mass of those suckers heading down the snack food aisle is lethal. Questions are at least as irrelevant as WM pointing out that the limo occupants were (legally) not wearing theirs.

I agree the “load” should be secured. I always wear my seatbelt and anyone riding with me has to wear theirs or they don’t ride. I just believe we should be personally responsible and not have the government require us to wear it.
And if someone’s body becomes a ballistic missile that results in injury or death they should be charged (if they survive) with negligence.
Accidents are caused or influenced by seatbelt use or non-use, but their use can reduce injury. Wal-Mart may argue lack thereof may have caused greater injury, but can’t lay any blame for their non-use.

Any such argument would fall on deaf ears if *I* was a juror.
My kids are long grown, and I rarely have anyone on the back seat these days, but for the last 10 years I insist that anyone in the back wear their seat belt. Why? A fascinating statistic..
In accidents involving high speed collisions, many front seat passengers who would normally survive because of their seat belts and air bags, are killed ( due to broken necks) when the rear seat passengers fly over the front seat and strike their heads.
Would wearing a seatbelt have protected them when they were rammed by a semi? No, find for the claimant.
I think it was the Walmart lawyers doing what lawyers do. This is where their PR team should step in and toss a little reality on the situation.
Was their lack of restraint the cause of some of the injury? Sure. Without doubt.
But that is meaningless in the court of public opinion.
Someone should tell the lawyers to shut up and settle this thing now. And by now, I mean today.
Walmart attorneys and Walmart PR people need to put their heads together here, because it looks like they’re trying to weasel out on damages from one of their vehicles ramming another. Might save them some money but might tarnish the brand and hurt sales.
They didn’t release it, it’s part of a court filing and so a matter of public record. I’m guessing the plaintiff’s attorney is the one who brought attention to it in order to feign outrage. I’m sure this “defense” by Wal-Mart was 100 % expected and routine.
I was able to avoid being run over and yelled out something like "Watch it" which got me a nasty look.
A minute later I was walking down a main aisle and had to move a little to avoid a cart coming the other way. Sure enough, he was right on my tail moving at whatever the top speed is of those carts and hit me again, luckily I felt him behind and wasn't hit hard. Then he cursed me out for getting in his way.
Told the wife that if I had been really injured the lawyers at Wal-Mart had better have proof that he was qualified to operate that damn scooter because he was a menace to everyone in the store.
Limos have seat belts...school busses don’t.
