If we're talking about it from the male point of view, sexual intercourse with someone who does not consent or is not capable of giving consent (unconscious, too drunk or stoned to consent, lacks the mental capacity to consent, below the legal age of consent) is rape.
Yes, a lot of those college girls who got very drunk or stoned last week and had sex, or were passing or passed out when someone was have sex with them, were legally raped. It's not practical to enforce that law except in extreme cases, such as sex involving date rape drugs, unconscious partners, when a guy gets a girl drunk specifically so she doesn't have the ability to consent, and some other situations.
