Perhaps not...but we all know that eventually an Osama Obama appointee will order it to be done and when it reached Kagan's in-box (assuming that she's the one who first gets appeals from military appeals courts),SCOTUS will refuse to take the case (It's my understanding that SCOTUS very seldom becomes involved in military cass).
