Ideally I would say yes.

But in some places, if the officers says “I believed that Nifster was driving chemically impaired. Since the tests are not accurate, they can not be used to prove his innocence.”

Since both the breathalyzer and the blood draw would come back showing nothing....I have nothing to worry about. If my driving was erratic then the officer has to describe that to the court....and maybe said officer would be correct. Though I stress that I work at being a good defensive driver out of a deep sense of self preservation
