Did the “QAnon Shaman” Get Shafted on Sentencing? New Footage Raises Questions Over the Chansley Case

If there is one image from Jan. 6th that will remain indelible with the day, it is the “QAnon Shaman.” Bare chested and wearing an animal headdress, horns and red-white-and-blue face paint, Jake Angeli Chansley is to the Capitol riot what Rosie the Riveter was to World War II. Howling and “chanting an unintelligible mantra” on the Senate floor, he is the embodiment of the unhinged rage that led to one of the most disgraceful attacks on our constitutional process in history.

However, the newly released Fox footage from that day raises serious questions over the prosecution and punishment of Chansley. The videotapes aired on Tucker Carlson this week show Chansley being escorted by officers through the Capitol. Two officers appear to not only guide him to the floor but actually appear to be trying to open locked doors for him. At one point, Chansley is shown walking unimpeded through a large number of armed officers with his four-foot flag-draped spear and horned Viking helmet on his way to the Senate floor.

It is otherworldly footage. While I admit that I approach these stories from the perspective of a long-standing criminal defense attorney, I would be outraged if I was unable to see such evidence before a plea or sentencing. At no point in the videotapes does Chansley appear violent or threatening. Indeed, he appears to thank the officers for their guidance and assistance. On the Senate floor, Chansley actually gave a prayer to thank the officers agreed “to allow us into the building.”

It irritates me to see money solicited for J6 defendants by entities/persons who do not give info/transparency on where the money goes. Why the secrecy? If legal fees, list the lawyers.

Right, if you ask the average person on the street what they know about Sicknick they’ll say something like, uh, wasn’t he the officer who was beaten to death by the crowd that day? They’ll say that because that’s impression that was crafted by the Democrats and the media. Tucker’s video corrects the record. Which obviously is a good thing, unless of course you’re the Democrats or the media.

Anyone arrested for jan 6th is a political prisoner. We live in East Germany, folks. Stop pretending we somehow have rights. democrats take away any rights anytime they want with virtually no pusb back.

I am actually disappointed by the fact that this man, as of this morning, is STILL in jail. He is obviously innocent of the “crimes” that he has been charged with.

The case can be made that he was essentially tortured into a confession/plea deal. Which is probably true for all the January 6th people.

Fox News is reporting sources as saying that these videotapes were handed over to the FBI soon after Jan. 6th. If true, the Justice Department did have the evidence and failed to turn it over to the defense as constitutionally required.. -Jonathan Turley

The role of Congress in withholding this footage is disgraceful and wrong. The Congress and the January 6th Committee knew of this footage and its relevance to a pending criminal case. Yet, they refused to make it public.

Here is a question for Professor Turley:

The "privileges and immunities" clause of Article I that protects Congress has an exception for " Treason, Felony and Breach of the Peace."

Article I Section 6:

They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

If it can be shown that members of Congress intentionally withheld information to obstruct Chansley rights in a felony trial, can they be charged criminally using the "felony" exception to the immunities clause?

Given what we know about the DOJ and the FBI, this is their modus operandi. This would be normal behavior.

What is worse is that even though even to the dimmest of bulbs that this is exculpatory material deliberately held from the defense, in violation of the Brady vs. Maryland ruling, that the majority of these political prisoners will be held for months or years more without bail or trial.

When you look at that ruling, the guidelines that classify Brady Evidence as such are:

  1. Any information favorable to the accused which may reduce a defendant's potential sentence

  2. Any information or evidence to impugn or diminish the credibility of an unfavorable witness

  3. Any information or evidence that would allow a jury to infer against the defendant's guilt.
Most normal people, even those on that jury, would not be disposed to classify that goofball with viking horns nearly being gently led by the police through the Capitol Building as a violent insurrectionist worthy of time in a filthy American Gulag.

Most normal people, even those on that jury, would be hard pressed to question the credibility of the unfavorable witnesses such as the police in the Capitol that day, or the government in general.

Most normal people, even those on that jury, would have to see that doofus with horns smiling and conversing with police, as someone not worthy of being kept incommunicado in a filthy cell for plotting to overthrow the government.

And one more thing-It is a certainty that they both had possession of the exculpatory video early on, and that they saw it early on. How many cameras do you suppose are in that area in question, which is the main area in question? Probably enough cameras to cover every square inch of that area. And how long were those people inside there? Not that long. They saw that footage within hours of getting it. There is zero doubt there.
