Not really so much. That’s a fixture in 1850s westerns. But in real law, there are dozens of ways a shot to the back van be legal and moral.
It’s more of a problem that he was not armed. Even that isn’t written in stone if he was successfully convincing people that he did have a firearm.

Mrs. Eagle and I went to a gun range to try out some weapons and the first time she pulled the trigger she shot about five more times in rapid succession.
The attendant came over and sternly warned her about rapid shooting. She tried to explain to him that that was the first time she'd ever fired a gun and it caught her by surprise. She didn't mean to do that at all. Jerkface puke just gave her the skunk eye and said if she did it again we'd have to leave.
We told him to eff off (but not in our out-loud voice) and went and bought her a weapon somewhere else.
Jerkface puke. We told him beforehand that was going to be the first time for her. He should've given her some sort of warning or at least been more understanding.
Did I mention he was a jerkface puke?
Whn deploying deadly force, the question of "right or wrong" is irrelevant, not the right question. The question is what will the prosecutor and judge do to punish you. Study this in advance.
Depends on what state you are in and/or if the perp has anything that belongs to you.
At the very most this should have been a suspended sentence.
Look I just feel he should have realized the neighborhood was too dangerous and moved his stop! It’s not worth his wife’s life or his. I’d love to have him in mine they seem like nice people and we could use a store like that where I live as we just lost our local 7-11.
He should have armed himself.
Or diapers for his 10 kids.
For the deceased,
There was video of it. He killed the man.
He lied about what happened, early on.
His wife was wounded a month earlier.
Sad case, but he was not justified when he shot.

That’s BS. In a chaotic scene, how that hell does a person have to be sure the bullet hits him when he is facing the victim.
