The Black Aces FIREARM is what the ATF calls it.
The "firearm" by Black Aces Tactical has all the characteristics of a short shotgun, without the name. It shoots 2 3/4" shotgun shells, uses a pump for cycling, and even leaves a big hole in whatever it shoots. But the ATF's own wording was used to design a firearms that cannot be called a shotgun, an SBS, an SBR, a pistol, an AOW.
If you still didn't get that, this firearm is not a shotgun, it is not a short-barrel shotgun, it's not a short-barrel rifle, it's not a short-barrel pistol. Again, it is a firearm. That is what it's classified as.
Black Aces Tactical designed this thing from scratch in its current state. In other words, it is not a modified firearm, shotgun, rifle, or anything else. It was designed from the ground up as you see it, therefore it never had an original classification of a shotgun, rifle, pistol, or anything like that. That being said, it was never fit with a stock. Given that its never been fit with a stock, the ATF does not classify this as a shotgun, and therefore its not an NFA item.

I did something similar in NY, seeing how “extreme” a gun I could build that was legally unregulated. 12ga, rifled, folding stock, pistol grip, red dot, pump, ... - it didn’t even fit the criteria of “firearm”.

Fun things like machine guns, suppressors, short barrel rifles and such require paperwork, money, and time because of it.
It’s a flare gun?
It is a “firearm”.
Not shotgun.
Not rifle.
Not pistol.
Not NFA anything.
The great thing about oppressive laws is they usually fit together badly, making for some bizarrely creative loopholes.
Ergo, you can get (with just a basic “yellow form”) a short-barreled compact shotgun with stock because, by poorly-worded legal definition, it’s not short-barreled, it’s not a shotgun, and it doesn’t have a stock.
At 1600$ it should be belt fed and semi auto firing from a open bolt.
I gotta give the manufacturer some credit here: (a) designing the firearm from the ground up to not fit the NFA is brilliant, and (b) the costs of developing and manufacturing it certainly are “putting your money where your mouth is”.
