McCain wouldn't be the leak. It would be the person who leaked the transcripts to him.

Except McCain is legally sworn to secrecy and privy to all sensitive information from whatever source...If someone "leaks" to McCain he's sworn not to disclose it.

If McCain "leaks" sensitive information he's more guilty of a crime than his source.
