Lawyers have etched out a plan for President-elect Donald Trump’s son-in-law, Jared Kushner, to serve in the new administration, according to a report.
Mike Allen said in his inaugural Axios AM e-letter early Monday that Kushner will serve as senior adviser. Kushner is reportedly now searching for members of his staff.
The New York Times reported last week that Kushner has been pursuing real-estate deal with a company that has close ties to China, all while advising his father-in-law during is bid for the White House.
According to the newspaper, Kushner hired the law firm WilmerHale for consultation on how he could follow ethics laws should he enter the Trump administration.
Just after Trump’s election victory, NBC News reported that the president-elect wanted Kushner to sit in on the daily presidential briefings. A transition official denied at the time that Trump had requested his children receive top security clearances.
Been rumors from way back - interesting they felt compelled to mention his real estate endeavors to date....
We’ll just have to trust in Mr. President-Elect’s judgement.

I don’t trust this guy’s politics, and it’s worth mentioning his real estate endeavors because he’s got a lot of potential conflicts of interest in any administration role.
I’d be interested to see how Democrats react to this. If they don’t complain about it the way they’re bleating about all of Trump’s cabinet appointments, I’d say that would be a huge warning flag to me.
So far there are no conflicts of interest for any Trump appointees, because none of them have taken their positions in the administration. (Today being Jan. 9.) Much ado about nothing. What they do at the time they start their jobs is another matter.

To me, his biggest "conflict of interest" has nothing to do with conflicts of interest as they are legally defined.
My concern is his politics, first and foremost.

Is “senior adviser” an official government position, like congressman, senator, etc.?
I know exactly how Democrats operate. Come here to New Jersey, and you’ll see how Kushner’s own father has been a major fundraiser and political supporter for the Democrats who turned this state into a giant sh!t-hole.
1. If he is paid for the role (I imagine he won't be, or he'll be paid a nominal salary of $1 per year).
2. If the role requires security clearances of any kind.
Oh they'll complain. And they'll point to 5 U.S. Code § 3110 which says that the President can't appoint family members to positions in the Executive Branch. Now there is a bit of an out, because the law also says that, " An individual appointed, employed, promoted, or advanced in violation of this section is not entitled to pay, and money may not be paid from the Treasury as pay to an individual so appointed, employed, promoted, or advanced." So theoretically Kushner could agree to serve without pay. But he cannot be reimbursed for any expenses and if he's putting together a staff then it's questionable whether the government would be able to pay them.
As is true of any successful business person. We're in for 4-8 years of enemedia accusations of conflicts at the presidential level as it is, what's one more?

They are not direct expenses of his so yes, I am pretty sure they would be paid.
I do not like the idea of family in official jobs in the WH. I don’t like the fact of the private security either. The Presidency is not a family business, nor is the President a celebrity with his own personal bodyguards. Any Pres can listen to whomever he wants including family but not in any official capacity.W may well have listened to his dad but he didn’t bring him to WH Intel briefings. The Pres Elect continues to be his own enemy with these decisions.
But they're staff of someone who is technically serving in violation of the law. However, assign them on paper to another part of the executive branch and "lend them out" to Kushner and the problem would be solved.
