Re read the Constitution. President is elected by a majority of “CERTIFIED electors”. Not “270 electors”. After all how many electors were there in 1810? I wager a dang sight fewer than 270. If the electors of WI, MI, and PA aren’t certified, they simply do not count at all and the majority winner of the rest of the electors becomes President. Without those three states it’s Trump 266 and Clinton 232. IE, he wins with the majority.
Actually, the 270 is established by LAW (12th Amendment). 270 = all states 50+Dc = 2 senators + Rep from each state. Do the math, 538 electoral votes. Majority = 270.
No again, if Trump only has 266 EV and Clinton has 232 EV, then it goes to the House per the 12th Amendment.
Here is the section on what if no nominee receives 270 votes from the US Gov. Hope this helps:
What happens if no presidential candidate gets 270 Electoral votes?
“If no candidate receives a majority of Electoral votes, the House of Representatives elects the President from the 3 Presidential candidates who received the most Electoral votes. Each state delegation has one vote. The Senate would elect the Vice President from the 2 Vice Presidential candidates with the most Electoral votes. Each Senator would cast one vote for Vice President. If the House of Representatives fails to elect a President by Inauguration Day, the Vice-President Elect serves as acting President until the deadlock is resolved in the House”.
