There is no set number of justices. If they don’t get their way will they then demand a rehearing before a ten-member court? Eleven? They had their chance, there is no second bite of the apple.

Pub. L. 114-38 (28 U.S. Code § 1 - Number of justices)

The Supreme Court of the United States shall consist of a Chief Justice of the United States and eight associate justices, any six of whom shall constitute a quorum.

(June 25, 1948, ch. 646, 62 Stat. 869.)

Thank you. I should have been more precise, no number set by the Constitution.

“full nine-Member Court” seems to me to be an attempt to disparage the legitimacy of the Court’s decision.
