It has been a week since reactionary House Republicans mounted a last ditch effort to either cut off federal money to Planned Parenthood or shut down the government. But the public interest won: Planned Parenthood and the federal government are still open. And that’s just the way Richard Nixon would have wanted it. […]

So “defunding” Planned Parenthood would primarily mean telling low income people that their Medicaid coverage is of no use for the health care provided by Planned Parenthood. […]

It would also be unconstitutional, according to a recent article by David S. Cohen, a law professor at the Thomas R. Kline School of Law at Drexel University. Prof. Cohen has pointed out that efforts by Congress and the state legislatures to defund Planned Parenthood amount to bills of attainder, or unconstitutional laws that inflict punishment upon a particular individual (or corporation) for an alleged wrong without a court trial. The Supreme Court has called bills of attainder “trial by legislature,” rather than by court. The framers would be mortified…

It may be an attainder depending on how it’s done.
Why not just ban using ‘fetal tissue’ from government funded abortions? There’s plenty of un-government funded ones to supply that industry.

So if Obamacare ensured that everyone has great healthcare, why do they need to go to planned parenthood? Why not just go to their regular doctor?

There is no constitutional requirement to fund Planned Parenthood or even to allow Medicaid to reimburse Planned Parenthood!

More than that, it is patently UNCONSTITUTIONAL for the feds to even be involved in abortion AT ALL. They have no constitutional authority whatever to interfere with state anti-abortion laws.

The feds are outlaws. Period.

How can defunding a government-dependent program be construed as “attainder” in any way, shape or form?

Attainder is the government declaring someone of being guilty of a crime without trial and acting to summarily punish said someone.

It's a load of crap. they tried the same thing when Acorn was defunded and the courts threw out the case with prejudice at the circuit level.

It is a pant load of nonsense. There is nothing that is funded by the government that can not be unfunded by the government. The legislature holds the purse strings in all events.

Well, they defunded Acorn. The fact that it is a hydra headed beast is no surprise. That is the entire problem with funding any programs. That is why we should not be in any of that nonsense.

You have it backwards: There is NO Constitutional authority for Congress to give penny ONE to PP, let alone for Medi-XYZ...

Often we are arguing defensively against the feds from the standpoint that WE have no constitutional requirement to do something.

This needs to be tuned around to an offensive attack against the feds that THEY are unconstitutional in ANY involvement with Planned Parenthood, much less paying them with our money.

The practical application of this is STATES need to reject federal interference with state anti-abortion laws and STATES need to kick Planned Parenthood and the rest out of the state.
