Dallas Criminal Defense Lawyer F. Clinton Broden of the Dallas based criminal defense firm Broden, Mickelsen, Helms & Snipes LLP obtained a copy of the search warrants issued on July 12, 2015 to search the mobile phones of the Waco bikers, including the mobile phone of his client (Matthew Clendennen), which were seized during their arrests on May 17, 2015. The Waco police departments affidavits requesting these search warrants, like the criminal complaints used to arrest the 177 bikers in this case, were simply fill in the name documents without any individual probable cause.

Theyre in the process of trying to cover up multiple murders under color of authority. There could be murder. There could be homicide. There could be justifiable homicide. The DA should know all about this by now.
The equally, perhaps more troubling aspect is the trampling of the Constitution going on before our eyes. I would like the Governor to get some oversight on this. No reason for the Feds- they are not friends of our liberty.
I heard this lawyer at Clendinen's presser. He knows what he's doing.

I think it would be more appropriate to escalate it to the state: the Attorney General or the Texas Rangers. --
That avenue isn't precluded by asking the feds to investigate an alleged violation of a federal statute. Escalate both places.

I’m sure its both. The higher ups are unwilling. And the rank and file are pressured not to talk.

IOW, the phone was being held without warrant for nearly a month. He should have told them the password was, “123456” but they’d probably have him back on another million dollar bond. They’re going to wish they’d never heard of Clendennen by the time this is over.
Has anyone heard of Broden is doing this pro bono? He should be. This case should make his name.

It is a restaurant that does have a bar section.
So it’s only a bar to the extent that a Cheddar’s or a TGI Friday’s is a bar.
Most people go there to eat.

Broden did say, however, that Mr. Clendennen willingly provided police with the password to access his mobile phone once he learned of the search warrant yesterday. Why the hell would someone provide them with a password? I'd tell them to stuff it.

In the 1979 Ybarra decision, the Supreme Court announced: Where the standard is probable cause, a search or seizure of a person must be supported by probable cause particularized with respect to that person. This requirement cannot be undercut or avoided by simply pointing to the fact that coincidentally there exists probable cause to search or seize another or to search the premises where the person may happen to be. Just as I thought.
And to think, just a couple days ago. some boot-licker on another Waco thread was lecturing me a out my lack of understanding of Probable Cause". I wonder where he is right now.

I'm not a lawyer, but Ybarra seems a bit of a stretch.
I think there is merit to attack the warrant against his client based upon the facts being too broad and "fill in the blank" style wording. He should be looking for things in the warrant that he can say don't describe his client's actions.
