A U.S. appeals court on Tuesday rejected a challenge to President Barack Obama's 2012 executive action granting deportation relief to immigrants brought to the United States illegally as children, upholding a lower court's earlier ruling.
A panel of the New Orleans-based 5th U.S. Circuit Court of Appeals found that the plaintiffs in the case - the state of Mississippi and a group of Immigration and Customs Enforcement officers upset by White House directives - had not shown they had been sufficiently harmed by the rule to keep the case alive.
"We conclude that neither the agents nor the state of Mississippi has demonstrated the concrete and particularized injury required to give them standing to maintain this suit," the decision stated.
The ruling comes as the same appellate court prepares to hear the Obama administration's appeal of a challenge to a landmark immigration overhaul unveiled last year that would let up to 4.7 million illegal immigrants stay without threat of deportation.

Sen. Alan Simpson warned over 20 years ago:
Americans are fed up with efforts to make them feel that [they] do not have that fundamental right of any people to decide who
will join them and help form the future country in which they and their posterity will live.
But if the elites and the advocates idea of giving voting rights to non-citizen majorities catches onand dont be surprised if it does -
Americans could be faced with the ultimate absurdity of people outside the social compact making rules for those inside it."
good pic and good quote.
We are not going to find relief from federal tyranny in federal courts.
This will insure a GOP victory in 2016.
I just wonder if the same judges are going to find the same when a Republican president takes over and reverses Obama's executive order?
This decision is the likely death knell for the 26-state lawsuit against DACA. That means Article V is the only path left to save our Republic.
Yup!
The solution is for us like minded folks to move to one state in the north-west. Take it over and kick out the feds.
We can’t fix this through the ballot box anymore. That time passed a long time ago.
illegal immigration hurts just about everyone.
This standing stuff is just typical liberal ends justifies the means garbage.
There are socialist ,one world judges that are on that cout. I expect the full court to hear this en banc. Hold your fire.
Obama. bots run the V circuit now.
Thanks Mitchy
Why hasn’t the TX judge ruled yet and the V the circuit jumped in ?
I have never heard of that before.
Can ANYONE tell me how, of the FEW Constitutional ‘jobs’ the Fed is delegated to accomplish (immigration and defending the borders) AND that the Executive branch is to FAITHFULLY EXECUTE existing Law (which it does not, and, in fact, creates Law out of whole cloth), does not show injury...let alone ‘standing’ (the black robed tyrants fall-back position)??
And the GOP/RNC response?? *crickets*
