Politically correct interpretations of the 14th Amendment’s (14A) Equal Protection Clause aside, the states have never amended the Constitution to expressly protect sexual identity as a right. So if TIME magazine really wants to push transgenderism as a constitutional right then it needs to do the following.

TIME must work with state and federal lawmakers to propose a transgender rights amendment to the Constitution to the states. And if the states choose to ratify the amendment then the feds will have the constitutional authority that they need to protect transgenderism through 14A and TIME will be a hero.
