If Brown and Johnson were walking away from the store with the stolen merchandise still in their possession, then they WERE still committing the crime that moment. They were fleeing the scene.

Is that like saying that bank robbers who are caught in the getaway car are not committing a crime at that moment?

Jaywalking was the original criminal offense. Assaulting an officer then fleeing the scene is what brought on the shooting.
