A stealth case moving through the Texas courts, athough yet to see a trial, addresses the issue of whether or not illegal alien students should continue to receive taxpayer funded grant monies for secondary education.The pivot point for the case, Lone Star College System of Texas & Richard Carpenter v. IRCOT, is winning on taxpayer standing. Governor Perry and many lawmakers approved instate tuition rates for illegal alien students in 2001. The sleight of hand on this was basically loosening "residency" requirements while failing to "affirmatively state" the benefit was designated to non-citizens in violation of federal laws.

Scott Brown, NHGOP, Rich Tisei(gay running for MA 6th district) NYGOP, MAGOP, MEGOP and most state level GOP are more conservative than Perry on tuition.
I think even Christie managed to only give them 90% of what the illegals wanted without the aid.
Someone who just came across from Mexico should not get in-state tuition that a kid from New Mexico cannot get.

A ruling from SCOTUS in 2011 hair pinned the notion of benefits and/or reduced taxes so that for the lawyer to pursue that angle put the case at risk. It was decided to just stick to the free money that flat out pays the full tuition they are getting.
