Texas Governor Rick Perry has been indicted for abuse of power. This is, unfortunately, the headline most Americans will see. They wont bother to look into the matter any further. Their reaction will be along the lines of yet another politician has abused his power. Usually this reaction is accurate. However, each case has to be looked at on its own. In the case of Perry, there isnt an iota of evidence that he abused his power. In fact, if we look at the facts it becomes clear that he exercised his lawful power under the Texas Constitution. That information is buried under a highly charged headline.
Rosemary Lehmberg is a District Attorney, a Democrat and a nasty drunk. She was arrested for drunk driving and tried to pull rank at the police station after her arrest. She was ultimately sentenced to 45 days in jail. Perry called on her to resign, as did others. Lehmberg refused. Perry then threatened to veto funding for her office and carried through with his veto threat when Lehmberg refused to resign. This is what constitutes abuse of power according to the indictment against Perry. Even liberals like Johnathan Turley and Alan Dershowitz think the indictment is ridiculous.
The Governor of Texas can veto any bill he wants, for whatever reason he wants. There is nothing unlawful about Perry vetoing a bill funding the office Lehmberg is part of. Yet Perry has been charged with abuse of power crimes for threatening to lawfully use his veto power. Lets imagine that this sort of charge against Perry sticks. Would it be an abuse of power for a Governor to threaten to veto funding for an agency he doesnt particularly care for? Lets say Perry doesnt like the Texas version of the EPA and vetos funding for it. Would that be an abuse of power?
You would have to think that vetoing or threatening to veto any bill would potentially bring abuse of power charges if the Perry indictment is successful. A Governor would either fund government in the manner the left wants it funded or face charges. Any personal disagreements between a Governor and anyone else in government could potentially bring about an indictment if funding is vetoed. In this case, were talking about a drunk, corrupt district attorney. Someone who should probably be suspended from the practice of law or disbarred. Trying to force her resignation isnt a crime, if anything is a crime its Lehmberg in office.
In this nonsense indictment you can see what the left is up to going into 2016. Perry is the second Republican Governor facing a bogus indictment. The other is Scott Walker of Wisconsin, who the left loathes and fears running for President. Theyre obviously afraid of Rick Perrys successful track record in Texas. While you would think Perrys weak debating skills wouldnt result in Democrat hysteria, they must be sufficiently afraid of his track record to the point that their fear overcomes his oops in the 2012 primary debates. One wonders which Republican will be the next to receive a phony indictment. Ted Cruz, Marco Rubio and Rand Paul must be on the Democrats radar.
