JJ scooped the story last week but the Hattiesburg American followed up with a killer story today on the city government running criminal background checks on witnesses in the recent election trial. The newspaper reported:




Testimony of witness intimidation left an ugly mark on the Ware v. DuPree election trial.



Now a transcript of in-chambers testimony reveals another instance of a witness feeling the heat.



Arthur Smith, a vocal Dave Ware supporter, was subpoenaed to testify July 26 regarding his missing absentee ballot.



He never did.



Before Smith’s scheduled testimony, City Attorney Charles Lawrence admits he ordered an FBI criminal background check of Smith through the Hattiesburg Police Department.



“It was in anticipation of a crime about to be committed,” said Lawrence of what he foresaw to be Smith’s potential perjury on the stand.



Lt. Branden McLemore testified in chambers on July 26 that he ran the background check through the National Crime Information Center under direct orders from his supervisor, Maj. Hardy Sims....



Lawrence said he was justified in ordering the background check through Sims because he believed Smith would testify falsely that he submitted an absentee ballot.



Lawrence said the witness testimony of deputy city clerks Hazel Young and Kermas Eaton showed Smith never completed his absentee ballot. He said he wished to see if Smith had a felony conviction that explained why he never voted.



“It (a felony conviction) would potentially impact why he never completed the voting process,” Lawrence said...."



Um, yeah.  These aren't even good lies. How much more proof does one need about how the Dupree-Fairly machine does thing in Hattiesburg. No surprise Precious Martin defended this bunch as he is the one who like to use constables to threaten people. Here is the transcript from the trial (WDAM originally posted it):

I recall being stationed at Camp Shelby MS, just outside Hattiesburg.

Everyone KNEW that the only reason we were there for five months was to pump Federal money into Trent Lott’s constichiency...

This is in regards to the election for mayor of Hattiesburg MS. An election that was clearly stolen.

The only reason I can see why Ware is fighting when Republicans generally don’t is the Republican Party is prohibited from challenging elections, and Ware is technically an independent. It’s a voluntary restriction on the part of the GOP, and does not apply to Democrats. I have no idea why this imbalance exists, but I’m pretty sure that it does.

Am I to understand a witness was intimidated by the city to keep him from testifying that his absentee ballot “disappeared?” First, how does he know that, is there something like a certified mail receipt sent to the voter? Secondly, the background check turned up a speeding ticket, that’s all. Why didn’t the witness show up to testify? Was there another action of intimidation besides the illegal background check?

Not to divert this thread, but I too pulled duty at Camp Shelby for a couple of weeks in the late 70s doing flight ops for a Medevac unit. The mosquitoes were so large they needed their own air traffic controllers. With the heat, mosquitoes and the missions we flew, never even thought about Lott.

This is the type of crap I tell my friends and lovers of big government is the issue about civil liberties.

When they kan’t wrap their head around it I start explaining Nixon and that the knife has two edges.

Do they honestly think as a tactic for winning(their team) it’s acceptable to use any action at any cost?

Or, or, again, or...would they be comfortable with another Nixon or another Republican acting on the foundational imprimature of precedent and then!!!; Moving the goal posts to where they want, controlling the referees, the time outs and total control of the clock???!!!!

Is that the game you want to play?

I’ll be the banker anytime you want to play Monopoly or The Dealer anytime you want to play Blackjack.

Or we can all play by rules everyone agrees to, lest chaos ensue.

It appears we are now going to get Voter ID in place so now is the time to start working on fixing the ABSENTEE VOTING FRAUD. We should have a consus in the stae to fix this. In the last Governors election both democrat candidates and that includes Mayor DuPree, said Voter ID is not where the fraud is in our election process but in the ABSENTEE VOTING AND BALLOT PROCEDURES. Sure looks like he knew what he was talking about.
