The Trayvon Martin Case, Update 32.5: The Prosecution Rests; The ME Explodes!

The final day of the prosecution’s case remained true to form in every respect, and also provided another glimpse—actually, a substantial look—into the prosecution’s closing arguments.

Sybrina Martin, Trayvon Martin’s Mother: The first witness of the day was Sybrina Martin, who testified that the screaming voice in the Lauer 911 recording is Trayvon Martin. The prosecution, not wanting to open the field to anything she might know about Trayvon, kept their questions limited to only that.

On cross O’Mara tried to make it clear that Sybrina might have reasons other than absolute truth to identify the voice as Trayvon. He may have had some success in that Sybrina seemed not only coached, but potentially rehearsed. She often tried to avoid directly answering O’Mara’s questions and parsed her answers so as not to concede even the most obvious points, even those not harmful to the prosecution. Her overall appearance was stoic, and the potential waterworks did not materialize.

It was clear that she was a prosecution witness through and through–a strangely rare occurance. It’s unfortunate that the jury will never hear that she has already won a seven-figure settlement, and has a continuing financial interest in the outcome of the case.

Jaharvis Martin, Trayvon’s Brother: A soft-spoken and well-spoken young man, Jaharvis confirmed his mother’s testimony, and like his mother, testified to nothing else. On cross, however, his credibility suffered badly. O’Mara caused him to admit that when he first heard the recording in the office of the Sanford Mayor with a substantial number of other people, he told others he was not sure the voice was Trayvon’s, but later changed his mind. He said he didn’t want to believe it was Trayvon due to “shock,” “sadness” and “denial.”

As with his mother, I detected coaching, and his answer regarding why he didn’t identify the voice as Trayvon’s at his first exposure to the recording seemed rehearsed, however, his demeanor was substantially more effective than his mother’s, and I suspect many viewers not familiar with these matters might not have picked up on that. He did not, for example, give the appearance of trying to avoid cooperating with the defense.

Dr. Shipping Bao, Medical Examiner: Dr. Bao, unlike Dr. Rao, actually conducted the autopsy on Trayvon Martin, which gave the prosecution the opportunity to display a wide variety of graphic autopsy photographs so that Bao could, in a perfunctory manner, identify them. The primary purpose, of course, was to elicit revulsion and sympathy in the jury................

FINAL THOUGHTS:

Two weeks of prosecution witnesses have ended without the prosecution proving, beyond any doubt, the three elements of the offense. As they offered no probable cause to prove those elements in the affidavit for the charge (Update 2) this is hardly surprising. In the many months from Zimmerman’s arrest to the trial, the prosecution could find no new evidence to demonstrate that the decision of the Sanford Police and the local prosecutor was wrong. The prosecution was also unable to prove beyond any doubt that Zimmerman’s self-defense account was unsupportable. In fact, most of their witnesses supported it, either fully or in part.

For readers unfamiliar with the workings of the law and the criminal justice system, it’s difficult to explain how utterly amazing and bizarre this is. As I’ve written, it’s as though the entire system suddenly turned backwards. For a prosecutor to complete his case and to be unable to disprove self-defense, offering nothing but theories unsupported by any credible evidence, and for a prosecutor to be unable to offer evidence to fulfill the elements of the offense is simply astonishing. It demonstrates what I, and others, have been saying for a very long time: this case should never have been filed; there is no evidence of a crime.

I expect a very aggressive, effective and devastating defense case. Consider how badly the prosecution did on offense, when they had every advantage in presenting and proving their case. Will they do better when they’re playing catch up?

The actual words as edpc points out:

Bao: “Nobody knows more about Trayvon Martin’s autopsy than me.”

West: “Except you don’t remember anything about the autopsy”

Bao: “Yes, without my notes.”

[Unless I am mistaken I don’t remember the state ever entering Bao’s autopsy into evidence. And Bao is up on the stand being questioned about this autopsy and he doesn’t even have it in front of him — just notes that were not even taken from the autopsy]

Because the Defense accused the Prosecution of WITHHOLDING EVIDENCE (the change by PingPong Bao from 3 minutes to 10 minutes)

When they moved the hoodie exhibit that had the bullet hole (the hoodie was encased in plastic) right in front of where she was seated, she looked at it and I could not see any emotion in her eyes at all. I found it strange. Almost like she was looking at a chair or something.

All she's seen since the beginning are dollar signs. Assisted, of course by Ben Crump.

Granted, I have watched very little of this trial, but I was struck by the strange expressions on Bao’s face. He smiled manically during his testimony. It was bizarre.

I would guess that it is in the process of being a “neighborhood in transition.” Before the TM shooting the residents tried to hold down the burglaries and incursion’s of the EBT Card holders but it was a losing battle after the MSMerde got into the act.
Would guess it soon will be part of an Obama Reparations Project.

In the context that I use Black Community, I am referring to Black Leadership, in as much as they are foisted upon us as the voice of the entire race, which of course is BS.. But as long as there are so few that are willing to refute the loudmouthed race-baiters, I am losing respect for the lot, in a general sense..

Many of my business partners and associates were of color, I hold my powder because I know the larger characterizations of any group, good or bad, are absurdly unfair... :)

So, Bao’s statement is comical in the fact that anyone with access to his notes (which should be on record in the case) knows just as much as he does...

...the exchange takes on a little more context, with the clarification...but still, to segue ‘no one knows more about the autopsy than I do’ into ‘{I don’t remember anything}without my notes’ is beyond comical...it’s so ridiculous I think the defense was caught off guard...did West say something like ‘so if I had your notes in front of me I’d know as much as you did about the autopsy?’ If he didn’t he missed a golden opportunity to make a complete monkey of this character in front of the jury...
...on second thought, I probably shouldn’t say monkey regarding this ME, for PC purposes...would ‘furred primate’ work?...

That’s about it! I posted yesterday, there would be no way I could watch this trial without the commentary and humor from freepers. I stated that my IPad would be full of bullets and vomit if I was watching alone.

I think he was just 'assisting'. He is the 'assistant' ME. BUT, it was thought that by using a CHINESE man (a trainee) instead of the actual person who did the examination (probably the technicians), the Jury would be impressed by his 'kung fu' and ignore any inconsistencies and chalk it up to 'miscommunication'.

I thought Bao didn’t actually do the autopsy...just signed off on it.

That's what he was trying to claim. He was trying to distance himself from it as best he could but he signed off on it. He is accountable for it. He was the medical examiner for that autopsy and he is trying to blame the technicians who he manages and who wrote down what he told them.

Prosecutor damn sure didn’t call on the woman that raised him.
No doubt she has said she could not tell who’s voice it is. She will not lie for money........the biological mother who DID NOT RAISE him, but calls him her “angel in heaven”, was called and said it was his voice. Hopefully MOM can clear some of this up and also find a way to get the marijuana on the record. Jury needs to know about the dope. When in the world has a toxicology report from the deceased not been admissible in court. Makes no sense. This stinks to high heaven.

Not only that, but he could well have been intending to introduce his little half-brother to the mix.

Chad isn't Trayvon's half brother. More likely Trayvon would have shared his 'purple drank' with Brandy Green's sister, who was back at the townhouse babysitting Chad.

He was a joke for the prosecution. But then again, so was their whole case against Zimmerman.
